Hamilton Faatz, PC represents clients in various processes of alternative dispute resolution (ADR). ADR processes are alternative methods of helping clients to either resolve their legal problems prior to filing a lawsuit or before going to court after a case has been filed. ADR involves a third party neutral who assists the parties to resolve their issues or narrow the areas of conflict. The use of ADR can result in the more efficient and cost-effective resolution of disputes. There are three major forms of ADR: mediation, arbitration, and mediation/arbitration (Med/Arb).

Our ADR Lawyers Help Clients Resolve Legal Problems Without Filing A Lawsuit

Mediationis a process in which parties to a dispute attempt to resolve their differences outside of a courtroom setting with the assistance of a trained mediator. Mediation can occur before a case is filed or after litigation has begun. If the parties are unable to reach a resolution during mediation, the parties may still seek court intervention to resolve their issues.

Arbitration is a process that is nearly identical to going to court. The arbiter (typically with the same credentials as a mediator plus some additional training), serves in the role of a “judge.” The arbiter hears the testimony of all sides, admits or rejects evidence, rules on objections and, at the conclusion, makes a binding ruling. The parties typically have no role in resolving the case; the decision-making process is taken out of their hands and is determined by the arbiter.

Mediation/Arbitration (Med/Arb) is a process in which the parties first try to mediate their own resolution to the dispute. If they are successful, the case is over. If they are unsuccessful, the matter proceeds to arbitration and the parties have no control over the resolution.
